TERMS OF PARTICIPATION IN THE COLOURS OF OSTRAVA 2026 FESTIVAL

VISITOR RULES

1. Introductory Provisions

  1. This Visitor Rules document is a directive issued by Colour Production, spol. s r.o., ID No.: 258 30 210, with its registered office at Sokola Tůmy 743/16, Mariánské Hory, 709 00 Ostrava, registered in the Commercial Register maintained by the Regional Court in Ostrava, Section C, File 19967 (hereinafter referred to as the “Operator” or “Organizer”), which sets out the basic binding rules for persons entering the premises of the Colours of Ostrava 2026 festival and using facilities located within the festival premises (hereinafter referred to as the “Visitor Rules”).
  2. The purpose of these Visitor Rules is primarily to ensure safety protection, fire protection, hygiene, protection of health and property at the Colours of Ostrava 2026 festival, as well as to ensure ideal conditions for the course of all events (hereinafter referred to as the “event” or the “Colours of Ostrava festival”) forming part of the Colours of Ostrava festival. The aim of the Visitor Rules is also to ensure a pleasant social atmosphere within the festival premises.

2.1. For the purposes of these Visitor Rules, the premises of the Colours of Ostrava festival shall mean visibly demarcated areas operated by the Operator in the Dolní oblast Vítkovice. The festival premises will be open to the public each day at the following times:

  • 15 July 2026: 12:00 – 2:30
  • 16 July 2026: 11:00 – 2:30
  • 17 July 2026: 11:00 – 4:00
  • 18 July 2026: 11:00 – 4:00

2.2. The Colours of Ostrava festival premises are visibly enclosed by fencing and entry to the premises is permitted only with a valid ticket or other identification designated by the Operator. By purchasing a ticket and/or presenting a ticket upon entry to the premises and/or entering an event within the Colours of Ostrava festival premises, each visitor expresses their consent to the conditions set out in these Visitor Rules, and at the moment of entry to the festival premises these Visitor Rules become binding on each visitor for the entire duration of their stay therein. For the purposes of these Visitor Rules, a visitor and/or member of the public shall mean any person entering the Colours of Ostrava festival premises, including representatives of the media and technical staff.

2.3. The provisions of these Visitor Rules shall also apply accordingly to persons entering the Colours of Ostrava festival premises on the basis of a special contractual relationship with the Operator and/or its contractual partners.

2. Colours of Ostrava Festival Premises

  1. By purchasing a ticket or receiving an identification wristband, a contract on participation in the Colours of Ostrava festival is concluded between the visitor and the organizer of the festival, Colour Production, spol. s r.o., with its registered office at Sokola Tůmy 743/16, Mariánské Hory, 709 00 Ostrava, ID No.: 25830210. Upon presentation of the ticket at the festival entrance, each visitor will receive an identification wristband to be worn on the wrist, which authorizes entry to the premises and replaces the ticket. A ticket shall mean both a printed ticket enabling entry to the festival to an unspecified person and an electronic ticket (so-called e-ticket) enabling entry to the festival to a specific person.
  2. Employees of the organizer and/or persons authorized by the organizer and/or members of the security service are entitled, upon entry to the Colours of Ostrava festival premises, to request presentation of an ID card or travel document proving the age of persons who claim a fresh ticket (persons born after 19 July 2004 or persons proving a child ticket – persons over 140 cm and up to 15 years of age) or seniors over 65 years of age on Saturday 18 July 2026. If a person does not meet the conditions for the given ticket, they are entitled to purchase the appropriate ticket at the difference in price, i.e., in the case of a fresh ticket, a four-day ticket in the amount of CZK 4,990. In the case of a child ticket, a fresh ticket in the amount of CZK 2,990, according to the relevant age of the person.
  3. Each person present in the Colours of Ostrava festival premises is obliged to wear an identification wristband and/or other document authorizing their stay in the premises for the entire duration of their stay, and upon request of an employee of the organizer and/or a person authorized by the organizer and/or a member of the security service, to immediately prove their authorization to stay in the premises. Anyone who is unable to prove their authorization to stay in the Colours of Ostrava festival premises may not be admitted and/or may be expelled from the premises. Visitors and members of the public may enter the Colours of Ostrava festival premises, or its respective designated zones, only with the consent of the operator, only during visitor hours and only in accordance with the conditions set out in these Visitor Rules. Any complaints may be made only before entering the premises.
  4. Supervision over compliance with and observance of these Visitor Rules within the Colours of Ostrava festival premises is carried out by duly designated employees of the operator and other persons authorized and duly designated by the operator, and within the scope of their legal powers also by the Police of the Czech Republic and the Municipal Police of Ostrava.
  1. Persons who are under significant influence of alcohol or other addictive or narcotic substances, as well as persons whose behavior endangers the safety and/or health of persons and/or property located in the Colours of Ostrava festival premises, lose their authorization to stay in the Colours of Ostrava festival premises and may not be admitted to the premises and/or may be expelled from the Colours of Ostrava festival premises by an employee of the organizer and/or a person authorized by the organizer and/or the security service. Likewise, persons who violate the rules set out in these Visitor Rules and/or persons who fail to comply with the instructions of employees of the organizer and/or persons authorized by the organizer may not be admitted to the Colours of Ostrava festival premises and/or may be expelled from the premises.
  2. Persons who, under the conditions of these Visitor Rules, are not admitted to the Colours of Ostrava festival premises and/or are expelled from the Colours of Ostrava festival premises are not entitled to compensation for the paid admission fee or any other costs incurred in connection with entry to and participation in the Colours of Ostrava festival. In such cases, the organizer may also limit or completely prohibit entry to the Colours of Ostrava festival premises.
  3. The sale of tobacco and alcoholic products to persons under 18 years of age is prohibited within the Colours of Ostrava festival premises.

3. Obligations of Visitors

  1. Visitors to the Colours of Ostrava festival are obliged to behave within the festival premises in such a way that their actions do not endanger the safety and/or health of third persons and/or their property, as well as the facilities located within the Colours of Ostrava festival premises, and further not to restrict, endanger or disturb other visitors beyond the level corresponding to the circumstances arising from the course of the Colours of Ostrava festival.
  2. Visitors to the Colours of Ostrava festival are obliged to comply with the instructions and orders of the organizer’s employees and/or persons authorized by the organizer and/or members of the security service, as well as the instructions and orders of the Police of the Czech Republic, the Municipal Police of Ostrava, the Fire Rescue Service of the Moravian-Silesian Region and the Medical Rescue Service of the Czech Red Cross.
  3. Visitors to the Colours of Ostrava festival are obliged to respect the rules arising from these Visitor Rules, generally binding legal regulations, as well as the rules of decent behavior and good morals.
  4. Visitors to the Colours of Ostrava festival are prohibited from bringing into the Colours of Ostrava festival premises – in particular – the following items:
  • racist, defamatory, vulgar or other materials contrary to good morals;
  • weapons of any kind, as well as all objects usable as cutting, stabbing or striking weapons or other objects that could endanger the safety, health or life of visitors (e.g. scissors, etc.);
  • sprays, adhesive, flammable (e.g. perfumes in containers over 200 ml), explosive, coloring or other substances endangering health;
  • bottles, containers, cans or other objects made of breakable, shattering or exceptionally hard materials;
  • fireworks/torches, flares, smoke bombs and other pyrotechnic items or ignition devices;
  • alcoholic beverages and/or addictive and narcotic substances;
  • materials promoting a political party or movement, or any politically oriented materials;
  • excessive backpacks and luggage, bicycles;
  • umbrellas;
  • laser pointers;
  • drones;
  • recording devices, film cameras and video cameras, professional and semi-professional cameras and SLR cameras.
  1. The organizer or persons authorized by the organizer, in particular the head of the security service (Supervisor) and/or their superiors, have the right to decide on the dangerousness and/or unsuitability of individual items brought by a visitor into the Colours of Ostrava festival premises. Inspection may be carried out upon entry to the premises or at any time after the visitor has entered the Colours of Ostrava festival premises.
  2. Visitors may be requested by the organizer or an authorized person to store unsuitable items or excessive luggage in the storage facility located next to the ticket office before entering the Colours of Ostrava festival premises. The decision of these persons is binding for the visitor. The organizer does not guarantee sufficient storage capacity or the permanent possibility to store unsuitable or prohibited items in this storage facility.
  3. Visitors to the Colours of Ostrava festival are obliged to allow the organizer’s employees and/or persons authorized by the organizer to inspect items and luggage brought into the premises for the purpose of checking compliance with the above provisions. If a visitor refuses such inspection under this provision, they may be denied entry to the Colours of Ostrava festival premises and/or may be removed from the premises.
  4. Visitors to the Colours of Ostrava festival agree to undergo security checks for the purpose of monitoring compliance with these Visitor Rules, including both luggage inspections and personal inspections carried out by the organizer’s employees and/or authorized persons and/or the security service upon entry to the Colours of Ostrava festival premises. If a visitor refuses to undergo a security check, they may be denied entry to the Colours of Ostrava festival premises and/or may be removed from the premises.
  1. Visitors to the Colours of Ostrava festival are further prohibited from:
    • displaying, spreading or publicly promoting racist, defamatory, vulgar or otherwise immoral slogans or images and/or inciting such conduct;
    • promoting any political party or movement, product or service;
    • climbing on or entering any structures and facilities within the premises, in particular façades, fences, walls, barriers, lighting equipment, trees, poles, roofs, railings, supporting structures, etc.;
    • entering areas not designated for the public and marked as inaccessible for these purposes;
    • throwing any objects into areas where visitors are present, in particular onto sports areas, stages and auditoriums;
    • making any audio or visual recordings within the Colours of Ostrava festival premises for commercial purposes or photographing any performances with professional or semi-professional cameras and SLR cameras without the prior written consent of the organizer;
    • smoking outside areas designated by the organizer;
    • bringing beverages into the Colours of Ostrava festival premises;
    • starting fires, igniting or launching any pyrotechnics;
    • unauthorized relocation of or other manipulation with equipment and/or facilities located within the premises;
    • manipulating in any way with water, electricity, air distribution systems or any other technical installations within the premises;
    • damaging any equipment and facilities located within the premises, including park trees and lawns;
    • writing on, posting on or painting any equipment, facilities or communications within the premises;
    • relieving oneself outside toilets or otherwise polluting the premises;
    • driving into the premises without prior consent or instructions from the organizer and/or persons authorized by the organizer;
    • threatening violence and/or committing violence against an individual or group of persons and/or inciting such conduct;
    • selling tickets or any goods without authorization;
    • distributing or placing any promotional or advertising materials within the festival premises without the prior written consent of the organizer;
    • entering with dogs or other animals, with the exception of assistance dogs for persons with disabilities;
  1. Visitors are not authorized, without prior written consent of the organizer and/or in breach of the conditions of the granted written consent, to carry out within the Colours of Ostrava festival premises any business or similar activity, nor to distribute and/or sell any items to other visitors, including newspapers, magazines, printed materials, advertising brochures, etc., nor to store any items within the Colours of Ostrava festival premises.
  2. A festival participant attends the festival exclusively at their own responsibility and is liable for any damage caused. The participant acknowledges that upon removal of the identification wristband the contract becomes invalid and they are no longer entitled to claim entry to the festival.
  3. A festival participant undertakes, within the framework of safety obligations:
    • when dealing with a fire, natural disaster or other extraordinary event, to provide adequate personal assistance, provided this does not expose them to serious danger or endanger themselves or a close person and no important circumstance prevents them from doing so, and to provide necessary material assistance;
    • to dispose of ash and cigarette butts and other tobacco products only in designated containers. To observe safety when lighting tobacco products (matches, lighters);
    • not to smoke in buildings and areas marked with a “No Smoking” sign;
    • not to damage installed safety signage;
    • not to damage or in any way restrict the use of installed portable fire extinguishers;
    • not to damage or in any way restrict the use of hydrant systems or other fire safety equipment;
    • not to damage or in any way interfere with installed electrical equipment;
    • not to damage or in any way restrict the use of control elements of installed technical equipment (electrical distribution cabinets, main switches, main water shut-off valves, etc.);
    • in the event of a fire alarm, to follow the instructions of the event organizer, members of the preventive fire patrol, security staff or members of the integrated rescue system;
    • to make payments within the Colours of Ostrava festival premises exclusively by means of cashless payment instruments (own payment card, mobile phone, smart watch or prepaid card). Breach of this obligation shall be considered a violation of the rules set by this Visitor Regulations, with consequences pursuant to Article 2.3. The organizer shall not be liable for any damage incurred by a festival participant due to the inability to use their cashless payment instrument (in particular due to insufficient funds, unsupported payment provider, technical failure of the payment instrument or the device in which the payment instrument is stored).

4. Liability for Damage

  1. The organizer shall not be liable for damage to property or health of festival participants unless such damage is caused by a breach of legal regulations by the organizer (intentionally or through gross negligence) and in direct connection with such breach. The organizer’s liability for damage is limited to an amount corresponding to the maximum price of the ticket purchased by the participant. The operator shall not be liable to a festival participant for damage arising in connection with refusal of entry to the festival premises or removal from the premises and denial of further entry as a result of a breach of obligations under these Visitor Regulations (in particular a breach of obligations under Articles 2.1., 2.2. or 3. of these Visitor Regulations).
  2. Visitors, especially elderly persons or persons with physical disabilities, must in their own interest move carefully on slippery and uneven surfaces and avoid injury. The organizer shall not be liable for injury caused by a visitor’s own negligence or failure to comply with these Visitor Regulations.
  3. Visitors are obliged to hand over to the operator and/or persons authorized by the operator and/or security service any items found within the Colours of Ostrava festival premises.
  4. If visitors find any suspicious items or items capable of endangering property, life and/or health of third parties within the Colours of Ostrava festival premises, they are obliged to immediately inform the operator and/or persons authorized by the operator, or the security service. Each visitor shall be liable to the operator and/or any third party for damage arising as a result of their breach of the rules set out in these Visitor Regulations and/or other binding legal regulations.
  5. The operator is entitled to require a visitor to surrender an item by which injury or damage was caused to the operator and/or any third party.
  6. Visitors are obliged to inform the operator and/or the security service of any injuries and/or damage occurring within the Colours of Ostrava festival premises and to sign a corresponding record. Without fulfilling this obligation, no claim for compensation may be made against the operator.
  7. In the event of evacuation of the Colours of Ostrava festival premises or other extraordinary situations, visitors are obliged to comply with the “Fire Emergency Directive and Evacuation Plan of the Premises” (available at the entrance to the premises) and are also obliged to follow the instructions of the operator and/or persons authorized by the operator, the security service and/or components of the integrated rescue system.

5. Other Provisions

  1. The organizer processes certain personal data of visitors as a controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council, i.e. the General Data Protection Regulation (hereinafter referred to as the “Regulation”). Comprehensive information on the processing of personal data within the Colours of Ostrava festival pursuant to Article 13 of the Regulation, including information on the purpose of individual processing activities, their legal bases, data recipients and the rights of the visitor as a data subject, is provided in a separate annex to these Visitor Regulations, which is available via the website www.colours.cz and at the festival venue.
  2. By entering the festival premises, visitors of the Colours of Ostrava festival agree, without further notice, to the free use of their image or likeness as part of any visual recording, transmission or production of events held within the Colours of Ostrava festival premises for commercial or promotional purposes within the meaning of Section 84 of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), in connection with the display of the entire event or its parts organized at the Colours of Ostrava festival premises by the organizer and/or its contractual partners. Consent to the use of image or likeness under this provision is granted by the visitor to the organizer and its contractual partners for an indefinite period, whereby the visitor is entitled to withdraw such consent. If such withdrawal is not justified by a substantial change of circumstances or another reasonable reason, the visitor shall be liable to the organizer pursuant to Section 87(2) of the Civil Code for damage incurred as a result of the withdrawal of consent. The processing of personal data in connection with the use of visitors’ visual recordings is governed by the information on personal data processing referred to in the previous paragraph.
  3. Visitors of the Colours of Ostrava festival further acknowledge that audio and/or visual recordings may be made within the Colours of Ostrava festival premises for the purposes of print, radio, television or similar reporting. Visitors acknowledge that, pursuant to Section 89 of the Civil Code, their consent is not required for the making of such recordings, provided that such recordings are used in an appropriate manner and such use does not conflict with their legitimate interests.

6. Final Provisions

  1. The rules set out in these Visitor Regulations may be further supplemented by rules relating to individual events held within the Colours of Ostrava festival premises. Such supplementary rules will always be appropriately published at the Colours of Ostrava festival premises or made available by the organizer or the security service, and visitors are obliged to comply with them.
  2. These Visitor Regulations come into effect on 12 July 2026.
  3. Rights and obligations not expressly regulated by these Visitor Regulations shall be governed by generally applicable legal regulations, in particular Act No. 89/2012 Coll., the Civil Code, as amended and effective.
  4. The organizer reserves the right to amend these Visitor Regulations at any time.
