Terms of Participation – Visitor Rules

  1. Introductory Provisions
    1.1.
    These Visitor Rules constitute a directive issued by Colour Production, spol. s r.o., ID No.: 258 30 210, with its registered office at Sokola Tůmy 743/16, Mariánské Hory, 709 00 Ostrava, registered with the Commercial Register maintained by the Regional Court in Ostrava, Section C, Insert 19967 (hereinafter referred to as the “Operator” or the “Organiser”). The Visitor Rules establish binding regulations for all persons entering the premises of the Colours of Ostrava 2025 festival grounds and using facilities located within the festival grounds (hereinafter referred to as the “Visitor Rules”).
    1.2.
    The purpose of these Visitor Rules is, in particular, to ensure safety, fire protection, hygiene, health and property protection at the Colours of Ostrava 2025 festival, as well as to ensure optimal conditions for the event (hereinafter referred to as the “Events” or the “Colours of Ostrava festival”) forming part of the Colours of Ostrava festival. The aim of the Visitor Rules is also to maintain an enjoyable social atmosphere within the festival grounds.
    1.3.
    For the purposes of these Visitor Rules, the festival grounds shall be understood to mean the visibly fenced premises operated by the Organizer within the DolnĂ­ VĂ­tkovice area. The Colours of Ostrava festival grounds will be open to the public each day from 8 PM on 13 July 2025 until 8 AM on 21 July 2025.[AV1]
    1.4.
    The Colours of Ostrava festival grounds are visibly fenced, and access to the area is permitted only with a valid ticket or other identification authorized by the Organizer. By purchasing a ticket and/or presenting a ticket at the entrance and/or by entering the festival grounds, every visitor expresses their agreement with the conditions set forth in these Visitor Rules. At the moment of entering the Colours of Ostrava festival grounds, these rules become binding on every visitor for the duration of their stay. For the purpose of these Visitor Rules, a “Visitor” or “Public” refers to any person entering the Colours of Ostrava festival grounds, including media representatives and technical staff.
    1.5.
    The provisions of these Visitor Rules apply accordingly to persons entering the Colours of Ostrava festival grounds under a special contractual relationship with the Organiser and/or its contractual partners.


2. Colours of Ostrava Festival Grounds
2.1.
By purchasing a ticket or receiving an identification wristband, a contract for participation in the Colours of Ostrava festival is concluded between the Visitor and the Organizer. Each Visitor will receive an identification wristband upon presenting a ticket at the entrance, which entitles them to enter the grounds and replaces the ticket. A ticket may be a printed ticket allowing entry for an unspecified person, or an electronic ticket (e-ticket) allowing entry for a specific person.
2.2.
Event staff and/or persons authorized by the Organizer and/or security service members are entitled to request an ID or a travel document proving the age of persons entering the Colours of Ostrava festival grounds with a Fresh Ticket (born after 20 July 2003), a Child Ticket (height above 140 cm and under 15 years of age), or a Senior Ticket (over 65 years) on Saturday, 19
July 2025. If the Visitor does not meet the conditions, they are required to pay the price difference: a Fresh Ticket holder must pay the difference to a full four-day ticket (CZK 4,790), and a Child Ticket holder must pay the difference to a Fresh Ticket (CZK 2,990), or to a ticket corresponding to their actual age.
2.3. Each person within the Colours of Ostrava festival grounds must wear an identification wristband or carry valid proof of authorization, and present it upon request by event staff, authorized personnel, or security. Failure to verify authorization may result in denial of entry or removal from the Colours of Ostrava festival grounds. Entry into the grounds or designated zones is only permitted with the Organizer’s consent, during designated hours, and in accordance with these Visitor Rules. Complaints may be made only before entering the festival grounds.
2.4. Compliance with these Visitor Rules is monitored by clearly identifiable staff of the Organizer, authorized personnel, and, within their legal authority, also by the Police of the Czech Republic and the Municipal Police of Ostrava.
2.5. Anyone who is under the significant influence of alcohol or other addictive or intoxicating substances, as well as anyone whose conduct endangers the safety and/or health of persons and/or property within the Colours of Ostrava festival grounds, forfeits their right to remain in the Colours of Ostrava festival area and may be denied entry and/or removed by the Organizer’s staff and/or persons authorized by the Organizer and/or the security service. Likewise, anyone who violates the rules set out in these Visitor Rules and/or fails to comply with the instructions of the Organizer’s staff and/or persons authorized by the Organizer may also be denied entry and/or removed from the Colours of Ostrava festival grounds.
2.6. Anyone who is denied entry to or removed from the Colours of Ostrava festival grounds under these Visitor Rules is not entitled to a refund of the admission fee or any other costs incurred in connection with access to or participation in the Colours of Ostrava festival. The Organizer may also restrict or completely prohibit such individuals from entering the Colours of Ostrava festival grounds.
2.7. The sale of tobacco and alcoholic products to persons under the age of 18 is strictly prohibited within the Colours of Ostrava festival grounds.

3. Obligations of Visitors
3.1. Visitors of the Colours of Ostrava festival take part in the festival entirely at their own risk and are liable for any damage they cause. They acknowledge that removal of the identification wristband renders the contract invalid and forfeits their right to enter or remain at the festival.
3.2. Visitors of the Colours of Ostrava festival are obliged to comply with the instructions and orders of the Organizer’s staff and/or persons authorized by the Organizer and/or the security service, as well as the instructions and orders of the Police of the Czech Republic, the Municipal Police of Ostrava, the Fire and Rescue Service of the Moravian-Silesian Region, and the Czech Red Cross Emergency Medical Service.
3.3. Visitors of the Colours of Ostrava festival are required to respect the rules arising from these Visitor Rules, applicable legal regulations, as well as the rules of decent conduct and good manners.
3.4. Visitors are strictly prohibited from bringing the following items into the Colours of Ostrava festival grounds:
a) racist, offensive, vulgar, or other such materials contrary to good morals,
b) weapons of any kind, as well as any items that may be used as cutting, stabbing, or striking weapons, or any other objects that could endanger the safety, health, or life of Visitors (e.g. scissors or similar),
c) sprays, corrosive, flammable (e.g. perfumes in containers over 200 ml), explosive, dye-based, or other substances hazardous to health,
d) bottles, containers, cans, or other items made of breakable, shattering, or exceptionally hard materials,
e) fireworks, firecrackers, flares, smoke grenades, and other pyrotechnic items or launching devices,
f) alcoholic beverages and/or addictive or narcotic substances,
g) materials promoting political parties or movements, or any politically oriented materials,
h) oversized luggage and suitcases, bicycles,
i) umbrellas,
j) laser pointers,
k) drones,
l) recording devices, film cameras and video cameras, professional and semi-professional photo cameras and DSLRs.
3.5. The Organizer or persons authorized by the Organizer, particularly the Head of the Security Service (Supervisor) and/or their superior, are entitled to decide on the dangerousness and/or inappropriateness of individual items brought into the Colours of Ostrava festival grounds by Visitors. Inspection may be carried out upon entry or at any time during the Visitor’s presence in the Colours of Ostrava festival grounds.
3.6. Visitors may be requested by the Organizer or a person authorized by the Organizer to store inappropriate items or oversized luggage in the cloakroom located next to the ticket office at the entrance to the Colours of Ostrava festival grounds. The decisions of such persons shall be binding on all Visitors. The Organizer does not guarantee sufficient cloakroom capacity or continuous availability of storage for inappropriate and prohibited items in this cloakroom.
3.7. Visitors of the Colours of Ostrava festival are obliged to allow the Organizer’s staff and/or persons authorized by the Organizer to inspect items and luggage brought into the grounds for the purpose of checking compliance with the previous provision. Should a Visitor refuse such inspection, they may be denied entry to and/or removed from the Colours of Ostrava festival grounds.
3.8. Visitors of the Colours of Ostrava festival agree to undergo a security check to ensure compliance with these Visitor Rules, including luggage inspection and personal checks conducted by the Organizer’s staff and/or persons authorized by the Organizer and/or the security service upon entry to the Colours of Ostrava festival grounds. Should a Visitor refuse to undergo a security check, they may be denied entry to and/or removed from the Colours of Ostrava festival grounds.
3.9. Visitors of the Colours of Ostrava festival are further prohibited from:
a) displaying, distributing, or publicly promoting racist, offensive, vulgar, or otherwise immoral slogans or images, and/or inciting such conduct,
b) promoting any political party or movement, or any product or service,
c) climbing on or entering any structures or equipment in the grounds, including but not limited to facades, fences, walls, barriers, lighting equipment, trees, poles, roofs, railings, support structures, etc.,
d) entering areas that are not open to the public and are visibly marked as restricted,
e) throwing any objects into areas occupied by other Visitors, particularly into sports areas, stages, or auditoriums,
f) making any sound or video recordings in the Colours of Ostrava festival grounds for commercial purposes, or photographing performances using professional or semi-professional photo cameras and DSLRs without prior written consent of the Organizer,
g) smoking outside the areas designated for smoking by the Organizer,
h) bringing beverages into the Colours of Ostrava festival grounds,
i) lighting fires or igniting or detonating any kind of pyrotechnics,
j) arbitrarily moving or otherwise tampering with any equipment and/or facilities located within the grounds,
k) tampering with water, electricity, air, or other utility infrastructure within the grounds in any manner,
l) damaging any equipment or facilities located in the area, including park greenery and grass areas,
m) writing on, pasting on, or defacing any equipment, facilities, or infrastructure within the area,
n) relieving oneself outside of toilets or otherwise contaminating the grounds,
o) driving into the grounds without prior consent or instruction from the Organizer and/or a person authorized by the Organizer,
p) threatening violence and/or committing acts of violence against individuals and/or groups of people, and/or inciting such conduct,
q) selling tickets or any goods without permission,
r) distributing or placing any promotional or advertising materials in the festival grounds without written permission from the Organizer,
s) bringing dogs or other animals into the area, with the exception of assistance dogs for persons with physical disabilities.
3.10. Visitors are not permitted, without prior written consent from the Organizer and/or in breach of the conditions of such consent, to carry out any business or similar activity in the Colours of Ostrava festival grounds, or to distribute and/or sell any items to other Visitors, including newspapers, magazines, printed materials, advertising leaflets, etc., or to store any goods in the festival grounds.
3.11. Each Visitor attends the festival solely at their own risk and is liable for any damage they cause. They acknowledge that removing the identification wristband renders the contract invalid and forfeits their right to enter or remain at the festival.
3.12. For safety reasons, each Visitor agrees to the following obligations:
a) to provide reasonable personal assistance and necessary material aid in the event of a fire, natural disaster, or other emergency, unless doing so would place them or a close person in serious danger, or unless prevented by other important circumstances,
b) to dispose of cigarette ash and butts from tobacco products only in designated containers, and to handle fire (matches, lighters) with care,
c) not to smoke in buildings or areas marked with a “No Smoking” sign,
d) not to damage installed safety signage,
e) not to damage or otherwise obstruct the use of installed portable fire extinguishers,
f) not to damage or otherwise obstruct the use of hydrant systems or other fire safety equipment,
g) not to damage or otherwise interfere with installed electrical systems,
h) not to damage or in any way obstruct the use of control elements of installed technical equipment (such as electrical switchboards, main switches, main water valves, etc.),
i) to follow the instructions of the event Organizer, fire patrol members, security personnel, or emergency responders in the event of a fire alarm.
3.13. Each Visitor undertakes to make all payments within the Colours of Ostrava festival grounds exclusively via cashless means (personal payment card, mobile phone, smartwatch, or a prepaid card purchased specifically for use at the event as an alternative payment method). Breach of this obligation shall be considered a violation of these Visitor Rules and is subject to consequences under Art. 2.3. The Organizer shall not be liable for any damage incurred by a Visitor due to the inability to use their cashless payment method (in particular, due to insufficient funds, unsupported payment provider, or technical malfunction of the payment method or device in which the payment method is stored).


4. Liability for Damages
4.1. The Organizer shall not be liable for any damage to the property or health of Visitors unless such damage is caused by the Organizer’s intentional or grossly negligent breach of legal obligations, and such damage is directly related to that breach. The Organizer’s liability for damages is limited to an amount not exceeding the price of the ticket purchased by the Visitor. The Organizer shall not be liable to the Visitor for any damage resulting from denial of entry to the Colours of Ostrava festival grounds or removal from the grounds, or prohibition of further access, due to breach of obligations under these Visitor Rules (in particular, under Articles 2.1, 2.3, or 3).
4.2. Visitors, especially those who are elderly or physically disabled, are required, for their own safety, to move with caution on smooth or uneven surfaces and avoid injury. The Organizer shall not be liable for harm caused by a Visitor’s own carelessness or failure to comply with these Visitor Rules.
4.3. Visitors are obliged to hand over to the Organizer and/or persons authorized by the Organizer and/or the security service any items found within the Colours of Ostrava festival grounds.
4.4. Should Visitors find any suspicious or potentially hazardous items that may endanger property, life, and/or the health of others within the Colours of Ostrava festival grounds, they are obliged to immediately notify the Organizer and/or persons authorized by the Organizer or the security service. Each Visitor is liable to the Organizer and/or any third party for harm resulting from a breach of these Visitor Rules or other binding legal regulations.
4.5. The Organizer is entitled to require a Visitor to surrender any item that caused injury or harm to the Organizer and/or any third party.
4.6. Visitors are obliged to report any injuries or harm sustained within the Colours of Ostrava festival grounds to the Organizer and/or the security service and to sign a corresponding incident report. Failure to fulfil this obligation shall exclude the possibility of asserting any claims for damages against the Organizer.
4.7. In the event of evacuation of the Colours of Ostrava festival grounds or any other emergency, Visitors are required to comply with the “Fire Alarm Directive and Evacuation Plan of the Grounds” (available at the entrance to the festival grounds) and follow the instructions of the Organizer and/or persons authorized by the Organizer, the security service, and/or emergency responders.

5. Other Provisions
5.1. The Organizer processes certain personal data of Visitors as a data controller within the meaning of Article 4(7) of Regulation (EU) No. 2016/679 of the European Parliament and of the Council, known as the General Data Protection Regulation (hereinafter referred to as the “Regulation”). Comprehensive information on the processing of personal data in connection with the Colours of Ostrava festival, in accordance with Article 13 of the Regulation, including details on the purpose of each processing activity, the legal basis, data recipients, and the rights of Visitors as data subjects, is provided in a separate annex to these Visitor Rules, available at www.colours.cz and at the festival grounds.
5.2. By entering the festival grounds, Visitors agree, without any further notice, to the free use of their image or likeness as part of any visual recording, transmission, or production of the event taking place in the Colours of Ostrava festival grounds, for commercial or promotional purposes within the meaning of Section 84 of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), as part of the depiction of the entire event or part thereof organized within the Colours of Ostrava festival grounds by the Organizer and/or its contractual partners. Consent to the use of image or likeness under this provision is granted to the Organizer and its partners for an indefinite period. Visitors may withdraw this consent; however, unless the withdrawal is justified by a substantial change in circumstances or another reasonable ground, the Visitor shall be liable to the Organizer for any damage caused by such withdrawal within the meaning of Section 87(2) of the Civil Code. The processing of personal data in connection with the use of visual recordings of Visitors is governed by the information referred to in the previous paragraph.
5.3. Visitors further acknowledge that sound and/or visual recordings may be made in the Colours of Ostrava festival grounds for the purposes of press, radio, television, or similar news coverage. Visitors acknowledge that their consent is not required for such recordings under Section 89 of the Civil Code, provided that the use is reasonable and not contrary to their legitimate interests.

6. Final Provisions
6.1. The rules set out in these Visitor Rules may be further supplemented by additional rules relating to individual events held within the Colours of Ostrava festival grounds. These supplementary rules shall be appropriately published within the Colours of Ostrava festival grounds or made available by the Organizer or the security service, and Visitors are obliged to comply with them.
6.2. These Visitor Rules shall enter into force on 13 July 2025.
6.3. Any rights and obligations not expressly regulated by these Visitor Rules shall be governed by generally applicable legal regulations, in particular Act No. 89/2012 Coll., the Civil Code, as amended.
6.4. The Organizer reserves the right to amend these Visitor Rules at any time.
